The Vietnamese Government has issued Decree 356/2026/ND-CP, annulling a number of its previous decrees. This move is based on Law No. 63/2025/QH15 on Organisation of the Government and Law No. 64/2025/QH15 on Promulgation of Legal Documents, which was amended and supplemented by Law No. 87/2025/QH15.

The Decree, signed by Deputy Prime Minister Le Tien Chau, annuls 18 government decrees in total. These include decrees related to various fields such as national reserves, cultural activities, people’s identity cards, and health organizations.

Annulled Decrees

Among the annulled decrees are the Government’s Decree No. 35-CP of May 27, 1995, which placed the National Reserves Department under the Government, and Decree No. 88-CP of December 14, 1995, on sanctioning administrative violations in cultural activities.

Other annulled decrees include those related to people’s identity cards, such as Decree No. 05/1999/ND-CP of February 3, 1999, and Decree No. 106/2013/ND-CP of September 17, 2013, which amended and supplemented the earlier decree.

Specific Annulments

In addition to annulling entire decrees, the new Decree also annuls specific articles and clauses within other decrees. For example, Article 3 of the Government’s Decree No. 103/2009/ND-CP of November 6, 2009, and Articles 6 and 7 of Decree No. 22/2023/ND-CP of May 12, 2023, are annulled.

Implementation Provisions

The new Decree takes effect on December 1, 2026. Ministers, heads of ministerial-level agencies, Chairpersons of provincial-level People’s Committees, and related agencies and units are responsible for implementing this Decree.

As the Vietnamese Government continues to update and refine its legal framework, these decrees play a significant role in ensuring that the country’s laws and regulations remain relevant and effective.

The annulment of these decrees will likely have a significant impact on various aspects of Vietnamese society and economy, as the government seeks to streamline its regulatory environment and promote further development.
