Vietnam Issues Decree Regulating Foreign-Sponsored Workers
Under Clauses 1, 2 and 3 of Article 11, workers may join political and socio-political groups as permitted by law.

Vietnamese workers employed by foreign organizations and individuals must follow the rules set out in Decree No. 371/2026/ND-CP, which defines their rights, duties and the procedures for managing their employment records.

Statutory rights for foreign-sponsored employees

Under Clauses 1, 2 and 3 of Article 11, workers may join political and socio-political groups as permitted by law.

They may also ask the designated agencies to give advisory support for protecting their lawful rights while employed by foreign parties.

A further right allows them to request assistance in certifying personal data held in the worker management dossier.

The agencies that can receive these requests are those delegated by the Ministry of Foreign Affairs to manage Vietnamese workers for foreign entities, as described in Article 5 of the decree.

To request assistance in certifying their personnel information based on the worker management dossiers, workers may submit a Vietnamese worker’s personal information form, a copy of the labor contract, and a certificate of completion of the program on dissemination and propagation of State policies and laws.

These documents are listed in Article 8 and must be prepared according to the forms attached to the decree.

Obligations workers must fulfill

Clauses 4 through 8, Article 11 of Decree No. 371/2026/ND-CP require workers to comply with Vietnamese laws on labor, protection of national security, social order and safety, and other relevant laws.

To properly perform labor contracts entered into with foreign organizations and individuals.

To complete the program on dissemination and propagation of State policies and laws within 6 months from the date of entering into a labor contract.

To comply with the regulations on management of workers and worker management dossiers prescribed in Articles 7 and 8 of this Decree.

To update their worker management dossiers and submit them to the managing agencies or organizations whenever their personal information changes or at the request of such managing agencies or organizations.

Updates can be sent directly, by post, or electronically through the official email addresses of the authorized agencies.

Key timelines for dossier submission

Clause 2 of Article 7 imposes a ten-working-day deadline from the contract date for submitting the personal information form and the contract copy to the managing agency.

The certificate of program completion, however, is not required within that ten-day window; workers have six months to finish the dissemination program, as stated in Clause 5 of Article 11.

If a contract ends, Clause 5 of Article 7 obliges the agency to issue a written termination confirmation and return the worker’s dossier within three working days after receiving notice of termination.

The decree becomes effective on 15 November 2026, so the above deadlines apply only to contracts signed on or after that date.
